The short version

1. What this is

Focus Garden is a focus timer that grows a garden from the time you spend concentrating. These terms are the agreement between you and the operator of Focus Garden (“we”, “us”) covering thefocusgarden.com and the desktop application of the same name (together, the “Service”).

By using the Service you accept these terms. If you do not accept them, please do not use it.

2. It is free

The Service is provided free of charge. There is no paid tier at present. If that ever changes, existing features you already rely on will not be taken away and put behind a payment without clear notice and a way to export everything first.

3. Your account

You do not need an account. Focus Garden runs entirely on your own device, and an account exists only so that your garden can follow you between devices.

4. Your data belongs to you

Your sessions, your projects and your garden are yours. We claim no ownership of them and no licence to them beyond what is strictly needed to run the Service for you: storing your data, showing it back to you, and syncing it between your own devices.

Settings → Export gives you the whole thing as a readable file, at any time, without asking us. What we do and do not store is set out in the Privacy Policy, which forms part of these terms.

5. Fair use

When using the Service, please do not:

Security research is welcome. If you find a vulnerability, report it to security@thefocusgarden.com rather than exploiting it or publishing it, and we will not come after you for having looked.

6. Our part of the bargain

We will do our best to keep the Service running, keep your data safe, and give you reasonable notice of changes that affect you. We are not promising a particular uptime, and the Service may be unavailable during maintenance or because a provider we depend on is having a bad day.

7. Availability, changes and the honest warning

The Service is provided as-is and as-available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that it will be uninterrupted, error-free, or that data will never be lost.

That is not boilerplate we would rather you skipped, so here it is plainly: keep your own copy of anything you would be upset to lose. The export exists for exactly this reason, and the desktop application keeps everything locally by design.

We may add, change or remove features, and we may discontinue the Service. If we ever shut it down, we will give at least 30 days’ notice by email to account holders so you can export your data.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service.

Where liability cannot lawfully be excluded, our total liability is limited to the greater of the amount you paid us in the twelve months before the claim (which, the Service being free, will normally be nothing) or one hundred US dollars.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so parts of the two paragraphs above may not apply to you. If you are a consumer, these terms do not affect your statutory rights.

9. Ending it

You may stop using the Service at any time, and you may have your account deleted by writing to privacy@thefocusgarden.com from the address on the account.

We may suspend or close an account that is being used to break these terms, to attack the Service, or to harm other people. Except where the abuse is serious or ongoing, we will tell you why and give you a chance to export your data first.

10. Third-party services

The Service depends on Cloudflare for hosting, Resend for email, and — only if you choose to use it — Google for sign-in. Their terms and privacy policies apply to their part of the arrangement, and we are not responsible for how they run their own services. They are listed in the Privacy Policy.

11. Changes to these terms

If these terms change materially, we will update the date at the top and tell account holders by email before the change takes effect. Continuing to use the Service after that means you accept the new version. If you do not, please stop using it and ask us to delete your account.

12. Governing law

These terms are governed by the laws of the State of Arkansas, United States, without regard to its conflict-of-law rules, and the state and federal courts located in Arkansas have exclusive jurisdiction over any dispute.

That is subject to one thing that matters more than the paragraph above: if you are a consumer resident somewhere else, you keep the protection of the mandatory consumer laws of the place you live, and you may bring proceedings there.

13. The rest

If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing something on one occasion is not a waiver of it. These terms, together with the Privacy Policy, are the whole agreement between us about the Service.
